Excerpts from regular Board Meeting held on April 05, 2022
The Board was approached by Mr. Rob Garrity of Finlo, LLC, requesting an extension on the permitted time frame allowed to complete construction on the Solar Energy System that was approved on January 5, 2021 for the properties owned by Mr. Paul Rosati located at 5170 Eureka Road (302.000-1-42) and O’Brien Road (289.000-2-55.2). The Town’s Solar Law states a Special Use Permit and Site Plan approval for a Solar Energy System shall be valid for a period of 18 months provided that a building permit has been issued or construction has commenced. Mr. Garrity explained that due to complications of COVID and with the Decommissioning Bond process, the construction got delayed and they are requesting an extension of the time frame to June 30, 2023.
Scott Toukatly made a motion to accept the request for extension to complete the Solar Energy System on properties owned by Mr. Paul Rosati located at 5170 Eureka Road and O’Brien Road to June 30, 2023 providing that no more extensions will be given at the end of initial extension and the applicant would need to return to the Board seeking for a new permit; motion was seconded by Chuck Smith; Paul Kulpa voted Yes; Joseph Malecki voted Yes; Roger Potenski voted Yes; John Smith voted Yes; Fran Szarek voted Yes; motion carried.
